Although you’re not required to give a recorded statement to anyone under California law, I usually recommend to my clients that they give a recorded statement to their own insurance company. Because their own insurance company will be likely to protect them, unlike the other driver’s insurance. So in any situation where the other driver’s insurance is asking you for a recorded statement, I would say, “No thank you.” Or, “Not until I have my attorney on the line with me.”
